海南第一涉外民商事法庭是经最高人民法院批复、中共海南省委机构编制委员会办公室批准设立的集中管辖发生在海口市、三沙市、儋州市、文昌市、琼海市、澄迈县、琼中黎族苗族自治县、昌江黎族自治县、屯昌县、临高县、定安县、洋浦经济开发区辖区内诉讼标的额人民币50亿元以下第一审涉外、涉港澳台民商事案件立案、审判及执行的机构。

法庭按照立审执一体化模式运行，内设立案组（包括案件管理办公室、诉讼服务中心）、审判组和执行组。现有6名法官，拟增配6名法官，拟共配备12名法官。法庭通过与中国国际贸易促进委员会海南省委员会、港澳台地区和其他国内外调解机构、国际仲裁机构等建立合作关系，加强涉外、涉港澳台民商事案件诉讼与调解、仲裁的线上线下对接,综合发挥社会机构的作用，完善多元化纠纷中立评估机制，拓展高标准、全覆盖的信息化纠纷解决方式，为域内外民商事主体提供公正、高效、权威、便捷的纠纷化解服务。

A  Brief  Introduction of  The First Foreign-related Civil and Commercial Court of Hainan

The First Foreign-related Civil and Commercial Court of Hainan is an organization established with the official approval of the Supreme People’s Court of China (SPC) and the permission of the Office of Government Set-up Committee of Hainan Province. The jurisdiction of the Court covers Haikou, Sansha, Danzhou, Wenchang, Qionghai, Chengmai, Qiongzhong Li and Miao Autonomous County, Changjiang Li Autonomous County, Tunchang, Lingao, Dingan and Yangpu Economic Development Zone. The Court has centralized jurisdiction of the case-filing, adjudication and enforcement of foreign-related civil and commercial cases at first instance with the subject of an action less than RMB 5 billion.

The Court runs by the integrative pattern of case-filling, adjudication and enforcement and consists of case-filling team, adjudication team and the enforcement team. Case Management Office and Litigation Service Center belong to the case-filing team. There are six judges at present and another six judges will be staffed as scheduled. Twelve judges would be manned to the Court. By cooperating with China Council for Promotion of International Trade Hainan Sub-council and other domestic and international mediation and arbitration organizations, the Court focuses on the online and on site connective procedures among litigation, mediation and arbitration of foreign-related civil and commercial cases including those concerning Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Region of the People’s Republic of China, aiming at perfecting alternative disputes neutral assessment mechanism and exploring the high-standard and all standing information-based disputes resolution, comprehensively playing its role as a social institution and providing impartial, efficient, authoritative and convenient dispute resolutions service for international and domestic parties in civil and commercial cases.
